Supreme Court rules against Warner Music in copyright damages case

The 6-3 ruling, authored by liberal Justice Elena Kagan, affirmed a lower court's decision that favored producer Sherman Nealy, who sued a Warner subsidiary and others in Florida federal court in 2018. Nealy has said that his label Music Specialist owns rights to the electronic dance song "Jam the Box" by Tony Butler, also known as Pretty Tony. Warner artist Flo Rida, whose given name is Tramar Dillard, incorporated elements of "Jam the Box" into his 2008 song "In the Ayer." The producer requested damages for alleged copyright infringement dating back to 2008. Circuit Court of Appeals reversed that decision and said there was "no bar to damages in a timely action."

Nintendo on Tuesday reported quarterly profit that beat market estimates and said it sold more units of its flagship Switch console than it had forecast. Here's how Nintendo did in its fiscal fourth quarter versus LSEG estimates:Revenue: 277.1 billion Japanese yen ($1.8 billion) versus 280.6 billion yen expected. Net profit: 82.6 billion yen versus 57.2 billion yen expected. Earlier this year, Nintendo hiked its forecast for sales of its flagship Switch console to 15.5 million units in its fiscal year ended March. The company said it expects to sell 13.5 million Switch consoles in the fiscal year ended March 2025.

Time isn’t inverting: Christopher Nolan’s “Tenet” is coming back to movie theaters for a week in IMAX 70mm and on other large-format screens. The limited re-release of Nolan’s mind-bender starring John David Washington will begin on Feb. 23, Warner Bros. The showings will also feature new footage from Denis Villeneuve’s “Dune: Part Two,” which opens a week later on March 1. “On ‘Dune,’ we shot several sequences for IMAX, and I simply loved it, so for ‘Dune: Part Two,’ we pushed it to 100 percent of the movie,” Villeneuve said in a statement. “I am just as eager to see ‘Tenet’ again, but now in 70mm IMAX, the way they filmed it, to fully appreciate his vision for this incredible film,” Villeneuve added.

Comcast topped both revenue and profit estimates in the third quarter, but the largest U.S. internet provider lost high-speed broadband customers and NBCUniversal advertising revenue slumped. NBCUniversal's flagship streaming service Peacock added 4 million subscribers and revenue increased 64% to $830 million, stemming the subscription service's quarterly loss to $565 million. Revenue rose 0.9% compared to the prior year period. U.S. broadband revenue rose 3.8% to $6.4 billion even as subscribers fell due to higher rates. Wireless revenue rose 16% to $917 million in the quarter on a net addition of 294,000 customers.
